MILWAUKEE, WI — Authorities in Milwaukee say a 35-year-old Whitefish Bay man has been arrested and charged after he shot and killed 47-year-old Tracey Smith, a Wisconsin Department of Corrections sergeant, in a bout of road rage following a routine traffic accident in Milwaukee.

Matthew L. Wilks has been charged with first-degree intentional homicide and possession of a firearm by a felon related to the Aug. 30 incident. He’s currently being held in the Milwaukee County Jail on a $2 million bond, according to jail records online.

According to a criminal complaint filed in Milwaukee County, a 17-year-old and his mother were driving to Playmaker’s Clothing Store, 5325 W. Fond Du Lac Ave. According to a WISN 12 report, Smith, “a sergeant with the State Department of Corrections, was teaching her son to drive.”

Authorities say the mother and son were going to make a left turn onto West Fond Du Lac Avenue from North 51st Boulevard when the driver of a gold van, later identified as Wilks, cut across their path in an attempt to make a left turn at the same intersection from the far right lane. Wilks’ attempt at an illegal left turn resulted in a collision, police said.

Police said as soon as the son stopped the car, Smith got out to look at the damage. The gold van also stopped in the intersection. While Smith was outside of their car, she stood near the front passenger’s corner of the car to see the damage.

Police said the driver’s door of the van then opened. Wilks did not get out of the van, but stood on the foot rail. Police said Smith was upset, and began to yell at Wilks about the accident. Police said Wilks threatened her, then pointed a gun and fired one shot, hitting her in the chest.

According to the criminal complaint, Smith then stumbled and fell to the ground, and Wilks fled in his van. Several people ran up to Smith and her 17-year-old son, and helped to drive her to St. Joseph’s Hospital. She died minutes after she arrived.

Investigators said they were able to see video surveillance footage of the shooting, and learned the shooter’s van, a 2004 GMC Savana Brown Van, was listed to Wilks. Wilks was later arrested and is currently being held in the Milwaukee County Jail.
